You may like to consider a lasting gift in support of plant conservation by making a bequest to the ANPC.

Your Will is an important legal document and to make sure your wishes are acted upon, correct wording is essential. We advise you to discuss your wishes with a professional legal advisor.

Unspecified pecuniary legacy:

The most straightforward form of legacy is an unspecified pecuniary legacy – this is a fixed cash sum specified in your Will, to be used at the discretion of the beneficiary organisation, within its rules.

If you do choose to leave an unspecified pecuniary legacy to the ANPC, please ask your legal advisor to include wording along the following lines in your Will:

 “I devise and bequeath to the Australian Network for Plant Conservation Inc., through the ANPC Public Fund and free of all taxes and other deductions, the sum of $___ or ___% of my estate to be used for its general purposes, and the receipt of the ANPC Public Fund or proper officer of the ANPC shall be sufficient discharge to my Executor/Trustee and I declare that my Executor/Trustee shall not be responsible in seeing to the application of such benefit.”

 

Other forms of bequest

These include:

• A specified pecuniary legacy (a fixed cash sum to be spent for a particular purpose);
• A residuary legacy (the residue of your estate after all other legacies, taxes, debts and expenses have been met);
• A conditional bequest (e.g. if your main beneficiary dies before you, then your estate to go to ANPC).

These require different wording and you should consult your legal advisor. In the case of specified-use legacies, we advise discussion with ANPC prior to finalising your Will, to ensure that what you have in mind is both practicable and within the rules of the ANPC.
